AP HC dismisses Ayyanna Patrudu plea; allows CID probe

AMARAVATI: The Andhra Pradesh High Court poured cold water on the hopes of TDP leader Chintakayala Ayyanna Patrudu on Wednesday when it rejected his petition for the quashing of the AP CID case. Ayyanna Patrudu and his son Chitakayala Rajesh were recently arrested by the AP CID for allegedly using forged documents to obtain a no-objection certificate (NoC) for an encroached piece of land over an irrigation canal.
Dismissing his plea on Wednesday, the High Court ordered the CID to proceed with its investigation into the case. However, it ruled that the Section 467 invoked by the CID was not applicable in this case. The High Court directed the Crime Investigation Department to proceed with the case after serving a notice under Section 41A.
Ayyanna Patrudu and his son Rajesh were arrested on November 3 in Visakhapatnam. The AP CID, in its case registered against them, charged them for allegedly encroaching 0.2 cents of land belonging to an irrigation canal and then fabricating a fake No-Objection Certificate to legally own the encroached land. The CID alleged that the accused had forged the signature of an assistant engineer of the Irrigation Department for this purpose.
The High Court on Wednesday maintained that an NoC could not be classified under value-based security and hence Section 467 was not applicable to the case. While directing the CID to serve a notice under Section 41A it ordered the continuation of the investigation in the case.
Ayyanna Patrudu and his son were granted bail by a Visakhapatnam court on November 4.
