Telangana HC: Prima facie case for quashing SSC leak charges against Bandi Sanjay
The Telangana High Court observed that BJP State president Bandi Sanjay Kumar had got a prima facie case for the quashing of the charges against him in the SSC question paper leak case
HYDERABAD: The Telangana High Court on Friday observed that BJP State president Bandi Sanjay Kumar had got a prima facie case for the quashing of the charges against him in the SSC question paper leak case. Telangana High Court Chief Justice Ujjal Bhuyan made this observation while hearing a quation petition filed by Bandi Sanjay a few days ago. The High Court also issued a notice to the complainant and posted the matter for further hearing to June 16, 2023.
The Hanamkonda police arrested Sanjay in the first week of April 2023 in connection with the SSC Hindi question paper leak case and remanded him to judicial custody. The court later granted a conditional bail to him. After being released from Karimnagar prison on April 7, the BJP state chief attended programmes during Prime Minister Narendra Modi’s visit to Hyderabad the next day.
On April 6, 2023, the police first detained Sanjay at his in-laws’ house in Karimnagar and later shifted him to Bommalaramaram police station under Rachakonda Police Commissionerate limits. After a day-long suspense and tension amid BJP’s protests, he was eventually produced before the Hanamkonda magistrate at her house. He was subsequently remanded to judicial custody.
The Hanamkonda police named 10 people in the remand report while Bandi Sanjay was listed as accused number one. A minor boy, who played a key role in the disclosure of the question paper from the examination centre, was also mentioned as an accused in the report. A case under Sections 120 B (conspiracy), 420 (cheating), 447 (criminal trespass), 505 (public mischief) besides the provisions of TS Public Examination (Prevention of Malpractices) Act and IT Act was registered.
The names of BJP MLA from Huzurabad Etala Rajender and his two PAs also figured in the report. The case was registered based on a complaint lodged by Kamalapur ZPHS Boy School Head Master M Shiva Prasad.
Following his release from jail on bail, Bandi Sanjay moved the Telangana High Court with a petition seeking the quashing of the case against him.
