TRS MLAs' poaching case: Telangana HC stays SIT notices to B L Santhosh
The High Court granted a stay on the notices issued to B L Santhosh till December 5, 2022, the order came on a quash petition filed on behalf of B L Santhosh
HYDERABAD: Bharatiya Janata Party (BJP) National Secretary B L Santhosh, who has been evading the questioning by the Special Investigation Team (SIT) probing the case of alleged attempt to lure four TRS MLAs into the party fold, on Friday received some relief from the Telangana High Court.
The High Court on Friday granted a stay on the notices issued to the senior BJP leader till December 5, 2022. The interim order of the High Court came on a quash petition filed on behalf of B L Santhosh. He challenged the issuance of the second notice to him by the SIT under Section 41A of the CrPC and dated 23-11-2022 in connection with the TRS MLAs' poaching case.
B L Santhosh, in his petition, contended that the requirements for 41A CrPC were not fulfilled in the notice.
Elaborating on this further, High Court advocate Karuna Sagar said that the quash petition was moved in the form of a lunch motion on Friday. The High Court objected to the issuance of the two notices, one on November 16, 2022, and the other on November 22, 2022, without showing any reasonable complaint or suspicion.
The High Court, according to Karuna Sagar, also found fault with the SIT for not mentioning any evidence or suspicion to fulfill the requirements of the CrPC provision in the notice. Consequently, the High Court granted stay on both the notices while adjourning the hearing on the quash petition to December 5, 2022.
