HYDERABAD: The Telangana High Court on Thursday held that the Governor could not reject the Cabinet recommendation on the appointment of MLCs under Governor quota.
The High Court was disposing of a petition by Prof Kodandaram and Amer Ali Khan who were appointed the MLCs under Governor quota by the Congress Government.
Earlier, the BRS Government had recommended the names of Dasoju Sravan and Kurra Satyanarayana as MLCs under Governor quota. However, after a prolonged delay, the Governor rejected the recommendation.

Both the candidates, however, had approached the High Court.
Later, after coming to power, the Congress Government recommended the. Amer Ali Khan of Siasat newspaper and Prof M Kodandaram, who had served as the chairman of Telangana Joint Action Committee during the moment. And, promptly Governor Dr Tamilisai Soundararajan gave her assent to this proposal.
However, Dasoju Sravan and Kurra Satyanarayana challenged the same in the Telangana High Court. This was, in turn, contested by Amer Ali Khan and Prof Kodandaram.
On Thursday, in its ruling the High Court felt that “Under article 171 (5), the governor has no power to reject the recommendation of the Cabinet.”
At the most she could have returned it to the Cabinet asking them to reconsider the decision, the court observed.
As it appears, the fate of all the four candidates are in limbo. And, once clarity emerges on the court ruling, the final outcome would be known.
