TRS MLAs poaching: HC orders accused to surrender, allows remand

HYDERABAD: Telangana High Court on Saturday ordered that the three accused in the MLAs' poaching case to surrender before the Commissioner of Police, Cyberabad within the next 24 hours.

The Court also said that they should be presented in the Anti-Corruption Bureau (ACB) court and then sent to remand for further investigation.

The court's decision, which was in favour of the Government, discarded the ACB court's decision and said that the police could send the accused into remand.

The Cyberabad police had appealed to the High Court that the three accused be remanded on a priority basis to investigate the issue and identify the names of the BJP leaders' involved, if any, after the ACB court rejected remand stating that there was no proper evidence and no cash seized.

Justice Chillakur Sumalatha of the Telangana High Court found fault with the judicial remand rejection orders of the Additional Special Judge, ACB Cases. It was ordered to the accused Ramchandra Bharati, Nanda Kumar, and Simhayaji Swami to surrender before the Cyberabad Police Commissioner and the concerned police to present the accused before concerned Magistrate within 24 hours.

The High Court ruled that once the accused were handed over to the ACB, the procedures could be followed.
