Disha case: TS police officers association petitions against Sirpurkar Commission report

The Telangana Police Officers' Association has filed a petition in the High Court against Justice Sirpurkar Commission’s report on the encounter of accused persons in Disha’s rape and murder case in November 2019.

HYDERABAD: The Telangana Police Officers' Association has filed a petition in the High Court against Justice Sirpurkar Commission’s report on the encounter of accused persons in Disha’s rape and murder case in November 2019.

The bench of Chief Justice Justice Ujjal Bhuyan and Justice N. Tukaramjee admitted the petition for hearing.

Advocate Niranjan Reddy presented arguments on behalf of the Police Officers’ Association. “Reports of the Commissions are not applicable in criminal cases. In those cases, the laws say that the CrPc provisions should be followed. The Commission was constituted by the Supreme Court to ascertain the truth. It is not a holy book like Bible or Quran,” he said.

Niranjan Reddy requested the High Court not to take the Commission's report as the basis for the investigation of the case.

He said that the Commission had commented in its report on many aspects of the investigation beyond its scope. It was inappropriate for the Commission to issue a report unilaterally while the criminal proceedings were going on and explained that these factors had an adverse effect on the career of police officers.

He said the police had to fire at the accused in self-defence only. All the petitions filed in this case should be dismissed, he urged. The court adjourned the case for further hearing to June 21.
