HYDERABAD: The District Consumer Disputes Redressal Commission in Hyderabad ordered Myntra Designs Private Limited to pay Rs. 9,099 to a Hyderabad shopper for deficiency of service and unfair trade practice.

Anusha Madishetty, a 28-year-old resident of Rasoolpura in Secunderabad, placed an order for a Safari trolley worth Rs. 3,000 from Myntra Designs Private Limited on June 19, 2023. The product was delivered on June 22, 2023, and as it was covered with stains and the quality was not up to the mark, the complainant raised a return request on June 26, 2023.

Anusha received a call on June 27, 2023, from pickup agents who informed her that the defective product would be taken the next day. When no one from Myntra Designs Private Limited came to take back the defective product, she called the customer care executive and requested them to resolve the issue.

Despite requesting Myntra Designs Private Limited to resolve the issue, the defective product was not taken back, and Myntra Designs Private Limited failed to pick up the defective product.

Anusha alleged that since Myntra Designs Private Limited had not provided proper and facilitated service, she had suffered irreparable loss and mental agony. Hence, she filed the present complaint and prayed for relief from the commission.

Myntra Designs Private Limited did not appear before the commission for reasons best known to them, and the evidence of Anusha remained unchallenged and unrebutted.

On perusal of the documentary evidence submitted by Anusha, it was evident that the return window was open until July 6, 2023, and Anusha placed the return request within this period.

Despite assuring Anusha that her issue would be resolved on priority, the opposite party did not pick up the product, and the issue was closed without resolution.

In the present case, as per the pleadings and documentary evidence, it was established that Myntra Designs Private Limited did not pick up the product after receiving the return request from the customer within the timelines and closed the window without resolving the issue. This amounts to a deficiency in service and the adoption of unfair trade practices by Myntra Designs Private Limited.

The act of Myntra Designs Private Limited has certainly caused mental agony and financial loss to Anusha. Hence, the court ruled in favor of the complainant.

Therefore, the complainant is entitled to a refund of the amount paid by her, along with just and reasonable compensation of Rs. 3,000. The court directed Myntra Designs Private Limited to refund the amount of Rs. 3,099 and pay Rs. 3,000 towards litigation costs within 45 days.
